CITIZENSHIP REQUISITES POST-JULY 1ST 2007
If you have procured rights of permanent residency later than 1st July 2007, the following pre-requisites have to be followed:
a. Lawful residence in Australia for a minimum period of 4 years and
b. A minimum stay of 12 months in Australia after procurement of permanent residence.
However, please keep in mind that satisfying the above condition is by no means any guarantee of the citizenship in Australia. Submission of the proper application is mandatory.
CITIZENSHIP REQUISITES PRE-JULY 1ST 2007
In case of receiving permanent residency prior to 1st July 2007, you are eligible for Australian citizenship is you meet the following criteria:
1. You have resided in Australia in the status of a permanent resident for a minimum period of 2 years in the previous 5 years and
2. You have resided in Australia as a permanent resident for at least 12 months in the last 24 months.
This implies that you must be a permanent resident who has lived in Australia for a minimum of 2 years prior to submission of application for Australian citizenship. This criterion is applicable till July 1st 2010. After that applicants will be assessed under the new Citizenship Act 2007.
There are also several other ways of procurement of Australian citizenship.
BIRTH IN AUSTRALIA
You are eligible for Australian citizenship:
In case of birth in Australia before 20th August 1986 or If born in Australia after 20th August 1986, one of the applicant’s parents is either a citizen or a permanent resident at the time of the applicant’s birth If you were born before 20th August 1986 but none of your parents hold citizenship or permanent resident rights. However if you have spent a major portion of your life in Australia before your 10th birthday, then you automatically become Australian citizen on your tenth birthday.
OVERSEAS BIRTH TO AN AUSTRALIAN CITIZEN PARENT
If you were born overseas and one of your parents is holding an Australian citizenship at the time of your birth, you are qualified for registering yourself as an Australian citizen. You can register at an Australian embassy overseas.
DUAL CITIZENSHIP
Australia permits its citizens to have dual citizenship. This implies that the Australian citizen can procure citizenship rights of another country without forfeiting his/her Australian citizenship.
You continue to be an Australian citizen even if you may have lived overseas for several years. You cease to be an Australian citizen only if you have procured another citizenship prior to 4th April 2002 or if you have voluntarily renounced your Australian citizenship.
